New Facebook TOS – They Own Your Stuff

The updates that Facebook made to their Terms of Service agreement are causing quite a fuss on the internets today. Here is the basic run down:

Anything that you upload, create, do, post, etc…on/with/to your Facebook account gives Facebook the right to use your material however they see fit.

So, if you upload a fantastic picture that catches the eyes of the Facebook team, they can use it without having to get permission from you (or paying you for it!!!).

Here is an excerpt:

You hereby grant Facebook an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to (a) use, copy, publish, stream, store, retain, publicly perform or display, transmit, scan, reformat, modify, edit, frame, translate, excerpt, adapt, create derivative works and distribute (through multiple tiers), any User Content you (i) Post on or in connection with the Facebook Service or the promotion thereof subject only to your privacy settings or (ii) enable a user to Post, including by offering a Share Link on your website and (b) to use your name, likeness and image for any purpose, including commercial or advertising, each of (a) and (b) on or in connection with the Facebook Service or the promotion thereof.

And another thing. Even if you cancel your account, they still have everything and will use it without asking:

The following sections will survive any termination of your use of the Facebook Service: Prohibited Conduct, User Content, Your Privacy Practices, Gift Credits, Ownership; Proprietary Rights, Licenses, Submissions, User Disputes; Complaints, Indemnity, General Disclaimers, Limitation on Liability, Termination and Changes to the Facebook Service, Arbitration, Governing Law; Venue and Jurisdiction and Other.

  1. This really is going to affect my use of Facebook.
    I am no longer going to post photos on Facebook and am going to be very careful with anything else I post.
    I guess the thing that upsets me is the fact that Facebook won’t/might not give credit to the creator.
    I”m curious why Facebook has done this.

  2. This will definitely affect my use of Facebook. I definitely will not be using it to post photos or anything else that I’ve done creatively. I think it’s shitty that anything that you put on Facebook will kind of stop belonging to you.

  3. @Jeremy and @lacienciocohete It will be interesting to see how many other users are taking your stand and will no longer upload photos and other creative work. I’m sure Facebook will notice a decline in the Photo Upload service.
